SECTION 2570




2570.  (a) Any person representing himself or herself as an
occupational therapist shall meet all of the following requirements:

   (1) Be a graduate of an occupational therapy curriculum that is
accredited by the American Occupational Therapy Association, the
World Federation of Occupational Therapy, or another nationally
recognized accrediting agency.
   (2) Meet either of the following requirements:
   (A) Be certified, or eligible for certification, by the American
Occupational Therapy Certification Board.
   (B) Have at least two years of appropriate experience as an
occupational therapist and have achieved a satisfactory grade on a
proficiency examination approved by the Secretary of the United
States Department of Health and Human Services.
   (3) Meet the qualifications prescribed by regulations of the State
Department of Health Services governing reimbursement of
occupational therapy services under Chapter 7 (commencing with
Section 14000) of Part 3 of Division 9 of the Welfare and
Institutions Code.
   (b) Any person representing himself or herself as an occupational
therapy assistant shall be a person who is certified, or eligible for
certification, by the American Occupational Therapy Certification
Board as a certified occupational therapy assistant, and shall meet
the qualifications for occupational therapy assistants prescribed by
regulations of the state department governing licensure of skilled
nursing facilities licensed pursuant to Chapter 2 (commencing with
Section 1250) of Division 2 of the Health and Safety Code.
   (c) It is unlawful and constitutes a misdemeanor for any person
not meeting the criteria of subdivision (a) or (b) to use, in
connection with his or her name or place of business, the words
"occupational therapist," "occupational therapy assistant,"
"certified occupational therapist," "certified occupational therapy
assistant," "occupational therapist registered," or the letters "OT,"
"OTA," "COT," "COTA," or "OTR," or any other words, letters,
abbreviations, or insignia indicating or implying that he or she is
an occupational therapist or to represent, in any way, orally, in
writing, in print or by sign, directly or by implication, that he or
she is an occupational therapist or occupational therapy assistant.
